TERMS OF SERVICE
FOR EMPLOYERS JOBIPO
These Terms of Service (“Terms”) govern the access to and use of the Jobipo Platform (as defined below) by employers, recruiters, placement agencies, consultants, companies, proprietors, partnerships, LLPs, and other legal entities posting job opportunities (“Job Poster”, “you”, or “your”).
These Terms constitute a legally binding contract between Adshrtech Media Private Limited (“Jobipo”, “Company”, “we”, “us”, or “our”), a company incorporated under the Companies Act, 2013, having its registered office at Shop No. 17–18, Ganesh Nagar, Benar Road, Nadi Ka Phatak, Neendar, Jaipur – 302013, Rajasthan, India, and you.
By accessing, registering on, or using the Platform in any manner, you confirm that you have read, understood, and agreed to be bound by these Terms, the Privacy Policy, and all additional policies, pricing plans, guidelines, codes of conduct, and service-specific conditions issued by Jobipo from time to time.
This document is an electronic record under the Information Technology Act, 2000 and does not require physical or digital signatures.
1. DEFINITIONS AND INTERPRETATION
Unless the context otherwise requires:
- 1.1 “Account” means a verified employer account created on the Platform.
- 1.2 “Active Period” means the period during which candidate applications remain accessible to the Job Poster.
- 1.3 “Applicable Laws” includes all central, state, and local laws of India, including labour laws, tax laws, the IT Act, 2000, and the Digital Personal Data Protection Act, 2023.
- 1.4 “Job Post” means any employment opportunity listed by the Job Poster on the Platform.
- 1.5 “Paid Services” means paid job posts, subscriptions, database access, credits, add-ons, or any other monetised service.
- 1.6 “Platform” means the Jobipo website, mobile application, dashboards, APIs, and communication tools.
- 1.7 “Third-Party Services” means services provided by third parties integrated with the Platform.
2. NATURE AND ROLE OF JOBIPO (INTERMEDIARY PROTECTION)
2.1 Jobipo is a technology platform acting solely as an online intermediary under Section 79 of the Information Technology Act, 2000.
2.2 Jobipo:
- does not act as an employer, recruitment agency, placement consultant, broker, or guarantor;
- does not verify candidate credentials, background, experience, or intent;
- does not guarantee responses, interviews, hiring, retention, or performance.
2.3 All employment relationships, communications, interviews, negotiations, contracts, and disputes are strictly between the Job Poster and candidates.
2.4 Jobipo shall not be a party to any employment agreement or dispute.
3. ELIGIBILITY AND AUTHORITY
3.1 You represent and warrant that:
- you are legally competent to enter into a binding contract;
- you are duly authorised to post jobs on behalf of your organisation;
- you possess all registrations, licences, approvals, and authorisations required to conduct recruitment activities.
3.2 If you act on behalf of an organisation, you confirm that you have full authority to bind such organisation to these Terms.
3.3 Jobipo reserves the absolute right to verify, approve, reject, suspend, or terminate any Account at its sole discretion.
4. ACCOUNT CREATION AND SECURITY
4.1 To access employer features, you must create a verified Account and provide accurate organisational and contact details.
4.2 You shall:
- maintain confidentiality of login credentials;
- ensure internal controls for authorised users;
- secure candidate data accessed via the Platform.
4.3 You are solely responsible for all activities carried out through your Account.
4.4 Jobipo shall not be liable for unauthorised access caused by your negligence or failure to maintain security.
4.5 Multiple employer accounts are prohibited unless expressly approved by Jobipo in writing.
5. JOB POSTS AND PLATFORM USAGE
5.1 Job Posts must relate only to genuine, lawful, and currently available employment opportunities.
5.2 You shall provide complete and accurate details including:
- job role and responsibilities;
- employment type and work location;
- compensation details (where applicable);
- education and experience requirements.
5.3 Jobipo reserves the unrestricted right to:
- approve or reject Job Posts;
- modify visibility or reach;
- remove Job Posts without notice.
5.4 Candidate applications shall remain accessible for 60 (sixty) days from submission, after which they shall be archived and inaccessible.
5.5 You shall not store, copy, transfer, sell, or retain candidate data beyond permitted access periods.
6. PAID SERVICES AND COMMERCIAL TERMS
6.1 Paid Services shall be governed by:
- these Terms;
- service descriptions and pricing displayed on the Platform;
- any order form, invoice, or service agreement.
6.2 Fees once paid are non-refundable, unless expressly stated otherwise.
6.3 Jobipo may modify pricing, usage limits, validity, and features at its sole discretion.
6.4 Jobipo does not guarantee any minimum responses, leads, or hiring outcomes.
7. DATA PROTECTION AND CONFIDENTIALITY
7.1 You acknowledge that candidate data constitutes personal data under Applicable Laws.
7.2 You shall:
- process candidate data lawfully;
- use such data solely for recruitment purposes;
- implement adequate security safeguards.
7.3 Jobipo shall not be responsible for your misuse, breach, or unlawful processing of candidate data.
8. EMPLOYER REPRESENTATIONS AND WARRANTIES
You represent and warrant that you shall:
- a. comply with all Applicable Laws, including labour and employment laws;
- b. not charge candidates any fees, deposits, or consideration;
- c. ensure non-discriminatory recruitment practices;
- d. post jobs only with proper authority;
- e. be solely responsible for decisions, communications, and outcomes;
- f. ensure authorised users comply with these Terms.
9. PROHIBITED ACTIVITIES
You shall not:
- post fake or misleading jobs;
- scrape or misuse candidate data;
- use the Platform for scams, MLMs, or unlawful hiring;
- bypass platform restrictions or safeguards;
- compete directly using extracted data.
Violation may result in immediate termination and legal action.
10. THIRD-PARTY SERVICES
10.1 The Platform may integrate third-Party Services including payment gateways, messaging tools, analytics, or automation.
10.2 Jobipo disclaims all liability for Third-Party Services.
10.3 Your use of such services is at your own risk and subject to third-party terms.
11. DISCLAIMER OF WARRANTIES
11.1 The Platform and Services are provided strictly on an “AS IS” and “AS AVAILABLE” basis.
11.2 Jobipo disclaims all warranties including:
- merchantability;
- fitness for a particular purpose;
- uninterrupted or error-free operation.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- Jobipo shall not be liable for indirect, incidental, or consequential damages;
- Total aggregate liability shall not exceed INR 1,000 (Rupees One Thousand only).
13. INDEMNITY
You agree to indemnify and hold harmless Jobipo against all claims, losses, damages, penalties, and legal proceedings arising from:
- your Job Posts or recruitment practices;
- violation of these Terms or Applicable Laws;
- Candidate or authority claims.
14. TERMINATION
14.1 Jobipo may suspend or terminate access at any time without notice.
14.2 Upon termination:
- access shall cease immediately;
- unused services may lapse without refund;
- Surviving clauses shall remain effective.
15. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the laws of India.
Courts at Jaipur, Rajasthan shall have exclusive jurisdiction.
